Simply put, that means if you qualify for this program (and we will review qualification guidelines with you at the time of your consultation), either you achieve 20/20 vision or we refund your procedure fees.

I wonder what the FTC will think about this ad? If "throw away your glasses" is illegal, surely this 20/20 guarantee has to be illegal. Here's another claim made on this website:

"Clinical data presented to FDA showed that quality of night vision after treatment was better than night vision quality before treatment, with either glasses or contact lenses;"

Well, let's just see whether that's true or not.

http://www.fda.gov/cdrh/PDF2/P020050b.pdf

From the FDA Summary of Safety and Effectiveness:

"Potential adverse effects associated with LASIK include: ....worsening of patient complaints such as double vision and glare, sensitivity to bright lights, increased difficulty with night driving..."

From Table 14, Patient Symptoms
3 months post-op 12% of patients reported "marked to severe" problems with night driving glare. (Ignore the pre-op questionnaires -- patients are clueless what night driving glare means prior to LASIK, and comparing pre-op night driving glare to post-op night driving glare is like comparing apples to watermelons).

http://www.fda.gov/cdrh/PDF2/P020050d.pdf

From the Patient Information Booklet, Page 14, large pupils is listed under Contraindications, Warnings, Precautions. It says, "patients with pupil sizes larger than the treatment area" are at risk of impaired vision.

This surgeon has the CRSQA seal of approval on his site. When I have a little more time, I am going to comb over the whole site and see what else I find that appears to be false and/or misleading.

J Cataract Refract Surg - Vol 29, August 2003

From the editor

Douglas D. Koch, MD

LASIK reporting: Preserving our responsibility to our patients

Excerpts:

Quote:
In my view, an even more repugnant approach is the "money back guarantee". This implies that the procedure is somehow reversible and that there are no potential risks of sight-threatening or sight-disturbing complications. Getting one's money back does not make up for a lifetime of unhappiness about one's vision; it is not like returning a broken television.

Quote:
Regulatory action is the next option and could include state licensing boards or the FTC. Obviously, illegal ads need to be reported to these agencies for action to occur. ASCRS has asked the FTC to become more active in stringently and consistently enforcing FTC regulations regarding legal advertising in refractive surgery.

Quote:
Primum no nocere: First do no harm. Do we practice medicine in the spirit of Hippocrates, or do we sell used cars?

I think Dr. Koch is right. This surgeon should be reported to the state licensing board and the FTC.

The FDA warns about claims like the one made by Dr. David Wallace:

Quote:
Be wary of eye centers that advertise, "20/20 vision or your money back" or "package deals." There are never any guarantees in medicine.

It appears that Dr. David Wallace has added a legal disclaimer to this repugnant and misleading guarantee:
