When I first started my website (Lasiksucks4U.com), warning others of the potential risks of LASIK surgery, I could not name the doctors involved due to litigation. After my med mal lawsuit, I added the doctors? names because I believed then (and still do) that as a matter of public safety, they should be named.

The doctors did not like this, and filed a defamation lawsuit against me. In the course of the 2 years it took for this case to appear before a judge at trial, my website was shut down 3 times, through intimidation and threats of lawsuits against my web hosting companies. On the second attempt, even after a temporary restraining order was denied twice by the courts, my site was shut down due to phone calls and a letter from the doctors? attorney.

Now I have been ordered by the court to remove the doctors? names from my websites, because he stated there was an agreement by the doctors and me. This was due to me changing my website to the state it was prior to adding, so that I would not get sued at that time. I am appealing his decision.

Are My Rights Being Violated?

YES! There was no confidentiality in the med mal lawsuit, although asked for at the very last moment by the doctors. There was no confidentiality in the defamation lawsuit, although some records have been sealed by the court. I have not ever given away my right to speak (or write) about my case, nor did I give up my right when my website was changed back to its original state in November 2003. The First Amendment does grant us Freedom of Speech!

Now A Plea For Help?

Public Citizen took an interest in my case, and the ACLU also took interest (they helped me obtain local counsel for my appeal).

I did an interview with the Star-LEdger about LASIK and the problems I had. My LASIK surgeon was also interviewed.

SHortly after, I received a threatening letter from his attorney about suing me for posting untruth statements about him..


I was 100% honest in everything I reported and he was the one who said he had ZERO complications!!

I've seen that before. My surgeon said he had done 8,000 LASIKs and I was the ONLY one with a problem. Wow! That's the lowest complication rate on record. He is better than all the other surgeons in the universe! :roll:

annemarie, keep speaking out. Your surgeon was just trying to intimidate you. He'd never get away with his lawsuit as long as you were telling the truth about your experiences with him and with laser eye surgery and HE was the one who was being dishonest.

It's a huge mistake to let intimidation threats like those silence your voice. It paves the way for others to be damage. Your voice is needed to spread the word about the risks of laser eye surgery, and to lend support to others who have been damaged.

If you read the article...my surgeon was the one who boasted that 98% of his Lasik patients had zero comlications!!!!!!!!!!!

If he published them he'd have to make the data accessible for external review. Don't think he'd want to do that as even the clinical trials data were not this good. Complications are inevitable, and higher than this. See the Peer reviewed journal section for plenty of documentation on this point.

ALL LASIK patients have induced higher order aberrations (reduced visual quality), ALL LASIK patients have abnormal corneal nerves (fewer, aberrant), ALL LASIK patients have a structurally weakened cornea with forward bulging, ALL LASIK flaps do not securely bond to the underlying stroma -- healing only minimally by forming a scar at the flap margin... I could go on and on. This does not sound like ZERO COMPLICATIONS to me.

All of the above can be found in the peer-reviewed medical literature section on this bulletin board.

By the way, he's the one that said that ALL LASIK patients lose contrast sensitivity.

Emretta Hinman, 40, claims that she went to Dr. Joseph Dello Russo - known locally through his rampant radio ads - to undergo the popular surgery so she could get rid of her eyeglasses.

In 2004, the embattled doctor settled for an undisclosed amount after a Manhattan engineer claimed that Dello Russo wrecked his eyesight. And last February, Dello Russo's insurer was ordered to fork over a $15.3 million malpractice settlement to 16 of his former patients.

Meanwhile, Dello Russo skipped most of the proceedings, arriving at the end and sitting in the back of the courtroom. After briefly striking up a conversation with reporters - and being admonished by his lawyers - Dello Russo slapped his hand over his mouth and said, "I'm not allowed to talk."
