Federal laws prohibit unfair or deceptive acts or practices in advertising, and false advertising of food, drugs, and services. The responsibility for enforcement of these laws as they apply to drugs and medical devices is shared by the Federal Trade Commission and the Food and Drug Administration.

To file a complaint with the FTC, call Matt Daynard at the FTC's Division of Advertising Practices, Bureau of Consumer Protection staff at (202) 326-3291 or email mdaynard@ftc.gov.

I recommend that you scan the article that contains false or misleading statements and email it to Matt Daynard. In your email, point out the exact statement that you believe is false and/or misleading and provide an explanation as to why the statement is illegal. I would strongly suggest you provide reference material to support your claim. The FDA labeling is a great reference.

A couple of examples of false or misleading advertising by LASIK providers are claims such as ?Throw away your glasses?, or ?Custom LASIK corrects tiny visual imperfections that glasses cannot correct?.

You are encouraged to post a copy of your complaint under the LASIK INDUSTRY PARTICIPANTS section of this bulletin board, and also on the Google newsgroup alt.lasik-eyes .

Posting copies of your complaints on these highly indexed forums will ensure that others seeking information about doctors and companies who engage in deceptive advertising will find the information they seek when they use internet search engines.
