20/20 Guarantee! If qualified patients do not achieve 20/20 vision
following their Wavefront IntraLase procedure - we guarantee a refund
of the total fee of your procedure.

Most patients think that visual acuity is their only concern. Patients
don't realize that you can be 20/20 with distorted vision and dry eyes.

These surgeons are counting on uninformed patients being lured in by
slick advertising hype.

Others in the field of ophthalmology find this ad "repugnant".

Not just repugnant, the ad is possibly a violation of FTC guidelines.

What are the ways in which advertising can deceive patients?

"Ads imply that the result will be perfect, permanent, and/or
complication free. Examples include "20/20 for $2995" or "20/20
promise" or "quick and pain-free way to eliminate your need for
corrective lenses."

"In my view, an even more repugnant approach is the "money back
guarantee." This implies that the procedure is somehow reversible and
that there are no potential risks of sight-threatening or
sight-disturbing complications. Getting one's money back does not make
up for a lifetime of unhappiness about one's vision; it is not like
returning a broken television."

Marketing Refractive Surgery: Doctor Beware

"The ASCRS and AAO guidelines for marketing refractive surgery are
divided into claims about effectiveness, safety, permanence and
predictability, success rates, and painlessness. These guidelines
provide a useful summary of some of the do's and don'ts of refractive
surgery advertising."

"The FTC has objected to claims that refractive surgery results are
permanent because of the lack of long-term studies to substantiate such
statements. In addition, as with effectiveness claims, the suggestion
that 20/20 visual acuity results are predictable in any given case are
potentially deceptive unless there are scientific data confirming that
such results have been achieved in virtually every case."

I suspect this ad is a "bait and switch". Notice they use the words "qualified patients". They lure you in with a 20/20 guarantee, then tell you that you don't qualify based on your refractive error.

Even the FDA warns against this type of advertising:


Be wary of eye centers that advertise, "20/20 vision or your money back" or "package deals." There are never any guarantees in medicine.
