Thank you for giving me this opportunity to be able to explain TLC?s Lifetime Commitment and what you will need to do if you have a complication after having Lasik with TLC.

I had Lasik eye surgery performed by Dr. David Boes in Billings Montana in March of 2000. That was the day I had my vision impaired. I paid $3,500.00 for the procedure. That was twice as high as I could have had it done at some of the more economical clinics. I paid extra because I was under the impression that TLC was the only company that really stood behind their work and I liked the idea that my local optometrist (Dr. Richard Jones of Cody Wyo.) would do the follow up care to make sure everything would go well. I found out later that even the cut-rate Lasic clinics have just as good results as the higher priced clinics. To make a long story short, Dr. Jones did a poor job of evaluating me for Lasik eye surgery, he was paid highly and I received an inadequate evaluation. There was a place on the pre Lasik exam for pupil size and that was left blank. I had a history of dry eyes and that is a contraindication for Lasik. A combination of my large pupils, -10 myopia, astigmatism and dry eyes should have told him that I was a bad candidate and that I should not have this procedure done. I believe that the high finder fee that TLC was paying him impaired his better judgment. The day of my treatment TLC did their own evaluation and they did the same thing. I believe TLC?s problem is that they try to run you though to fast.

After about 6 months of trying to get TLC to help me with the problems they created I gave up and had to travel all around the country seeing specialist and finally having more Lasik eye surgery by Dr. Jack T. Holladay in Houston, Texas to correct some of the Screw ups that Dr. Boes and Dr. Kontos left me with. With all of my expense of traveling from Wyoming to Montana to Texas to California and then to Florida to see specialist I had spent over $20,000.00 on trying to get my eyes fixed. My eyes are a lot better now and I owe most of that to Dr. Holladay.

If you have a complication and you had surgery with TLC and they kick you to the curb like they did me, then this is how the Lifetime commitment works. First you have to have deep pockets. You will have to spend lots of money to prove your eyes are screwed up, you are kidding yourself if you think they will admit they did something wrong. You will have to spend a lot of time looking for an attorney to represent you. You will have to prove negligence and this can be very costly. When most find out how costly it can be then they will back out. TLC is counting on that when they give their Lifetime Commitment. The Lifetime Commitment states that they will stand behind their work if it is fixable; if they can?t fix it then you are on your own to find someone who can at your own expense. I was lucky, it took me almost five years but I was able to settle out of court with TLC, I got all of my money back that I had to spend on my eyes and also enough to pay off my attorneys and not a penny more. If someone was considering having Lasik eye surgery with TLC and they asked me my advice, I would have to tell them they need their head examined!

I am doing the best I can now to get on with my life, I wish I would have never heard of Lasik or TLC. No one in my 52 years of life every treated me as bad as Dr. Boes did after he screwed up my eyes. I would have had more satisfaction of just dragging his ass out of his clinic and beating the shit out of him rather than going to all the trouble of taking him to court. I have lost a lot of money because of what he had done to me.

It is inspiring to hear that you did emerge victorious in your battle with TLC. What's your vision like now after the retreatment?

Eye,
My vision is still compromised. When my eyes dilate past the ablation zone I get double vision in both eyes. I have days when my eyes are to dry and that will also distort my vision. In the wintertime when I have to turn on the defrosters in my vehicle I can watch my vision deteriorate. Glasses do not correct my problems. Dr. Holladay corrected only part of my problems but it was enough to make it bearable for me. He corrected my depth perception problem. Prior to Dr. Holladay my vision made me nauseous, he also had to remove some debris left under my flaps by TLC and removed some epithelia in-growth. Dr. Holladay told my wife and Bernie Brown ?Doctors that leave their patients in the state that they left me should be shot?. :evil:

once you get to know people on the inside, you notice that there seem to be a lot of TLC patients, thats definitely true.

:evil: After nine months of not being able to work and numerous attempts to try and get TLC to do something to help me with my vision I was desperate. How long can you wait for someone to help you when you are not able to work? How long would you put off helping them when you know you are the one that put them in this state? I finally had to bite the bullet and go and seek outside help and I knew it was going to be expensive.
I was recommended that if anyone could help me it would be Dr. Jack Holladay in Houston Texas. I called to see if I could get in to see Dr. Holladay and the lady on the other end told me he was booked for about 2 months. I couldn?t believe what I was hearing, I couldn?t help it, I started crying and telling the lady ?Look, I need help, I am going crazy here, I haven?t been able to work for nine months, TLC keeps putting me off and they just don?t care, I need to do something soon!? She said give me a couple minutes and I will call you back. She called back and said ?can you be here in three days?? I said ?count me there?.
Below are the list of problems I was left with by TLC

1. debri under both flaps
2. I had epithelia ingrowth
3. Depth Perception Problems
4. Severe dry eyes
5. I was left with an effective optical zone of less than 5 mm
6. Under corrected in both eyes
7. Contrast Sensitivity Problem

Dr. Holladay told me that he could help me with some of this but not all. He had to lift both flaps and clean them before he could relaser. That felt terrible, I could feel him irrigating both eyes and then it felt like he?s was taking a toothbrush to my eyes to clean the debris out.

The next day I could tell he had helped me tremendously. One thing he couldn?t help me with and it was one of the reasons I should have never had the surgery in the first place was that my pupils were too large (7mm) and my correction was to high (-10) pre Lasik. Caused me to have an effective optical zone of less than 5 mm.

Jack Holladay made time to help me during the Christmas Holidays, I had to go back and see him in March for a follow-up. After I had finished up with him I called TLC back to see if there was any way they could help me with my expenses. After all I did have a lifetime commitment. That tape helped me in my case, she lied about numerous things. The big thing she lied about was trying to get me lined up the Dr. Machat in Canada. Court records show that my records never crossed his desk until two years after my first surgery and one year after I finished up with Jake Holladay. Can you believe it, I couldn?t work and they were going to put me off for 2 years before they helped me.

The other thing she lied about was my mono vision, you heard what she said, it was textbook perfect. Did you count how many times she said I was TEXTBOOK PERFECT! ? Dr. Holladay is known world wide and respected, he would have never operated on both of my eyes if they were textbook correct!

I especially liked the section in the tape when they put me on hold and the background recording said, we will take care of you forever! And it is true, TLC did finally come through and help me, but it did cost me over $50,000.00 in Attorneys fees and medical expenses.

The moral of this story is: If you are considering having Lasik Eye Surgery with TLC, make sure you have an extra $50,000.00 in the bank before you do in case you have complications!
